DMCA POLICY: COPYRIGHT INFRINGEMENT NOTIFICATION

FireAnime ("We," "Us," "Service") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), the text of which may be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, We will respond expeditiously to claims of copyright infringement committed using the Service that are reported to Our Designated Copyright Agent identified below.

1. DMCA SAFE HARBOR DISCLAIMER

FireAnime is an Online Service Provider under Title II of the DMCA, 17 U.S.C. § 512. We provide a search engine and indexing service that links to third-party content. WE DO NOT HOST, UPLOAD, STORE, OR TRANSMIT VIDEO CONTENT ON OUR SERVERS. All video content found through the Service is hosted by unrelated third parties.

2. SUBMITTING A TAKEDOWN NOTICE (17 U.S.C. § 512(c))

If You are a copyright owner, or are authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Service by completing the following DMCA Notice of Alleged Infringement and delivering it to Our Designated Copyright Agent.

Upon receipt of a Notice as described below, We will take whatever action, in Our sole discretion, We deem appropriate, including removal of the challenged material from the Service.

Required Elements of a DMCA Notice

To be effective, the Notification must include the following:

  1. Physical or Electronic Signature: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of Copyrighted Work: Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
  3. Identification of Infringing Material: Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit Us to locate the material. YOU MUST PROVIDE THE SPECIFIC URL(S) OF THE INFRINGING CONTENT. GENERAL LINKS TO PROFILE PAGES OR SEARCH RESULTS ARE NOT SUFFICIENT.
  4. Contact Information: Information reasonably sufficient to permit Us to contact You, such as an address, telephone number, and, if available, an electronic mail address at which You may be contacted.
  5. Good Faith Statement: A statement that You have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. Accuracy Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that You are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

WARNING: UNDER 17 U.S.C. § 512(f), IF YOU KNOWINGLY MISREPRESENT THAT MATERIAL OR ACTIVITY IS INFRINGING, YOU MAY BE LIABLE FOR DAMAGES, INCLUDING COSTS AND ATTORNEYS' FEES, INCURRED BY US OR THE ALLEGED INFRINGER.

3. COUNTER-NOTIFICATION PROCEDURES (17 U.S.C. § 512(g))

If You believe that material You posted on the Service was removed or access to it was disabled by mistake or misidentification, You may file a Counter-Notification with Us. To be effective, a Counter-Notification must be a written communication provided to Our Designated Agent that includes substantially the following:

  1. Signature: Your physical or electronic signature.
  2. Identification of Material: Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access disabled.
  3. Statement under Penalty of Perjury: A statement under penalty of perjury that You have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  4. Consent to Jurisdiction: Your name, address, and telephone number, and a statement that You consent to the jurisdiction of the Federal District Court for the judicial district in which the address is located (or if you are outside of the United States, that You consent to jurisdiction of any judicial district in which the service provider may be found), and that You will accept service of process from the person who provided the DMCA notification or an agent of such person.

4. REPEAT INFRINGER POLICY

In accordance with the DMCA and other applicable law, We have adopted a policy of terminating, in appropriate circumstances and at Our sole discretion, users who are deemed to be repeat infringers. We may also at Our sole discretion limit access to the Service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
